Eminent Domain, Fair Compensation, and RL21

One of the most significant threats to property rights is the misuse of eminent domain for private gain. While eminent domain is sometimes necessary for public projects, Sheryl Johnson insists that it should only be used as a last resort, with full transparency and just compensation for landowners.

 

Sheryl supports legislation that strengthens landowners' rights to review full disclosure of the dangers of the proposed pipelines and challenge eminent domain actions. She'll also champion legislation that will demand that compensation reflect not only the market value but also the sentimental and long-term value of the land.

 

Sheryl strongly opposes Referred Law 21, the so-called “Landowner Bill of Rights” that is actually a “Special Interest Bill of Goods.” This law was written by special-interest lobbyists behind closed doors to make it easier for companies to push through pipelines against the wishes of local residents. It strips away local control and provides no additional protection for landowners and communities against dangerous pipelines. Sheryl is actively working with a broad, nonpartisan coalition of Republicans, Democrats, and Independents to inform South Dakotans on the realities of this bad law and urge its defeat.
